Welcome to Sharpe, a mobile application operated by MAYTECH LLC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Sharpe mobile application (the "App") and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. ELIGIBILITY

Account Creation: You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials.

4. INTERVIEW CREDITS & PURCHASES

Virtual Currency: Interview credits are virtual items that grant access to AI-powered mock interviews. Credits are purchased through Apple's In-App Purchase system.

Credit Policies:

Purchases: All purchases are processed by Apple through StoreKit and are subject to Apple's Terms of Sale. We do not store or process payment information.

Refunds: All sales are final. Refunds are handled by Apple according to their refund policy. Contact Apple Support for refund requests. We may, at our sole discretion, provide refunds for unused credits in exceptional circumstances.

Pricing: We reserve the right to modify credit pricing at any time. Changes will not affect credits already purchased.

Third-Party Content: The Service may contain content licensed from third parties, including Apple, OpenAI, ElevenLabs, and others. All rights in such content are reserved by their respective owners.

Feedback: If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use such feedback without any obligation to you.

Game Center: Our App uses Apple Game Center for leaderboards and achievements. Your participation in Game Center is subject to Apple's Game Center Terms of Service.

Leaderboard Data: Game Center leaderboard data is managed by Apple. We do not control what appears on leaderboards or how Apple displays this information.

Fair Play: You agree not to:

Informal Resolution: Before filing a claim, you agree to contact us at support@getsharpe.app to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith for at least 30 days.

Binding Arbitration: If we cannot resolve a dispute informally, you and MAYTECH LLC agree that any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules.

Arbitration Location: Arbitration will be conducted in Wayne, New Jersey, or another mutually agreed location.

Class Action Waiver: You agree to bring claims only in your individual capacity and not as part of any class or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may bring a claim in small claims court if it qualifies. Either party may seek injunctive relief in court to prevent actual or threatened infringement of intellectual property rights.
